1. General
1.1
These Terms and Conditions apply to all insurance applications, quotations, payments, and services provided by the Company.
1.2
The Company is licensed to provide marine and liability insurance solutions in Malaysia.
1.3
By submitting an application or making payment, the Applicant agrees to be bound by these Terms and Conditions.
2. Application & Acceptance of Risk
2.1
Submission of an application or payment of premium does not constitute acceptance of risk or issuance of insurance coverage.
2.2
Insurance coverage is only effective upon issuance of a Policy, Cover Note, Certificate of Insurance, or written confirmation by the Company.
2.3
The Company reserves the right to accept, decline, postpone, or modify any application at its sole discretion.
3. Underwriting Requirements
3.1
The Company may require additional information, documentation, vessel details, or risk surveys before policy issuance.
3.2
Failure to provide requested information or complete required survey(s) may result in cancellation of the application.
4. Survey Requirement
4.1
The Company may require a pre-insurance survey or inspection prior to policy issuance.
4.2
The Applicant shall provide full cooperation and access for the survey process.
4.3
Refusal or failure to complete the required survey shall be deemed as non-compliance and may result in cancellation of the application.
5. Premium Payment
5.1
Premium must be paid in full before policy issuance unless otherwise agreed in writing.
5.2
All payments are subject to third-party payment gateway, banking, or processing terms.
5.3
The Company shall not be responsible for delays or failures caused by third-party payment providers.
6. Cancellation Before Policy Issuance
6.1
The Applicant may request cancellation before policy issuance.
6.2
Where cancellation is requested after payment has been made but before policy issuance, the Company may refund the premium, subject to deduction of:
a)
Non-refundable payment gateway charges,
b)
Banking fees, and/or
c)
Administrative or processing costs incurred by the Company.
6.3
No insurance coverage exists if the policy has not been issued.
7. Refund Policy
7.1
Approved refunds shall be made to the original payment method or bank account where possible.
7.2
Refunds are subject to verification and approval by the Company.
7.3
Processing time for refunds is up to fourteen (14) working days from approval.
7.4
The Company reserves the right to withhold refund until all required information is completed.
8. Policy Issuance
8.1
Insurance coverage only begins upon issuance of a valid policy document or written confirmation.
8.2
The Company may revise terms, conditions, warranties, or premium prior to policy issuance.
9. Duty of Disclosure
9.1
The Applicant must disclose all material facts relevant to the risk.
9.2
Failure to disclose material information may result in rejection of application, cancellation of policy, or denial of claims.
10. Fraud & Misrepresentation
10.1
Any false declaration, misrepresentation, fraud, or omission may result in immediate cancellation and forfeiture of benefits.
10.2
The Company reserves the right to take legal action where necessary.
11. Limitation of Liability
11.1
The Company shall not be liable for any indirect, consequential, or financial losses arising from application delay, rejection, cancellation, or refund processing.
12. Governing Law
12.1
These Terms and Conditions shall be governed by the laws of Malaysia.
12.2
Any disputes shall be subject to the jurisdiction of Malaysian courts.
13. Amendment
13.1
The Company reserves the right to amend these Terms and Conditions at any time without prior notice.
